terms of service

These terms are a contract between you and Finnbrose Labs LLC (“Finnbrose,” “we,” “us”) for lowkal.app, the LowKal waitlist, and the LowKal apps when they are available.

Contact: [email protected]

1. What LowKal is

LowKal is software for logging meals and seeing calorie (and optional macro) estimates. If you connect Apple Health or Health Connect, step count can raise the day’s calorie budget.

LowKal is a general wellness product. It is not medical advice, diagnosis, treatment, or a substitute for a clinician. Numbers are estimates. Food databases, barcodes, recipe imports, and any future scanning can be wrong. You are responsible for how you use the numbers.

If you have a history of disordered eating, or you are under the care of a clinician for nutrition or weight, talk to them before using a calorie tracker. Do not use LowKal to treat an eating disorder.

2. Who can use it

You must be 18 or older. Do not create an account or join the waitlist for someone under 18.

You must be able to form a contract. If you use LowKal for a company, you represent you can bind that company.

3. Waitlist

Joining the waitlist means: we may email you when LowKal is available, and we may offer you first access.

Price we are offering waitlist members today

The waitlist is not a purchase, preorder, reservation of a license, or a guarantee that LowKal will launch on a date, or at all. We can change or withdraw the waitlist offer before you actually subscribe. If we cancel LowKal, we owe you nothing for having joined the waitlist, because you have not paid us yet.

We will not sell waitlist emails.

4. The free log and the paid plan

When the app is available:

Free, and meant to stay free: logging meals (including chips, pairings, and a daily calorie target) and a budget that can move with steps if you connect health data. We will not put ads in the log-a-meal flow.

Paid (LowKal paid plan): extra math and convenience we describe in the app, which we currently intend to include macros, history beyond a short window, recipe URL import, and higher or unlimited barcode lookup if those lookups cost us money. We may adjust the paid feature list, but we will not move basic meal logging behind a paywall.

Subscriptions are billed by Apple or Google through the store account you use. Their refund and cancellation rules apply. Manage or cancel in that store’s subscription settings. Unless the store requires otherwise, paid fees are non-refundable once the period has started.

Waitlist pricing applies only to the first year of a paid subscription you start using the waitlist offer, and only if we still honor that offer at checkout. After that year, the then-current price applies.

We do not have to offer a weekly plan. We do not change the price we show you after onboarding using hidden A/B tests. The price on lowkal.app is the price.

5. Your account and your log

You are responsible for your sign-in and for what you log. Do not share your account.

You retain whatever rights you have in the content you enter (meal names, notes, photos of packages if we ever support that). You give Finnbrose a limited license to host and process that content only to operate LowKal, back it up, and fix bugs.

Do not upload anything illegal, anyone else’s personal data without a right to, or content you do not have the right to use (including copyrighted recipe text scraped and dumped in violation of someone else’s terms).

We may close accounts that abuse the service (spam waitlist, scrape, attack, resell access, harm others).

6. Health data connections

Connecting Apple Health or Health Connect is optional. You can disconnect in system settings. We use step data to adjust the calorie budget. We do not sell that data or use it for advertising. More detail is in the Privacy Policy.

7. Acceptable use

Do not:

8. Intellectual property

LowKal, the wordmark, the site, and the app are owned by Finnbrose Labs LLC. These terms do not give you any ownership. You may not copy the product or our marks except as needed to use LowKal or as fair use / applicable law allows.

“LowKal” is used as the name of this app. Other companies use similar names for unrelated products. We do not claim those.

9. Third-party services

The site and app rely on other companies to host data, measure traffic, send email, and (when the app ships) to distribute the app and process payments through Apple or Google. Their terms and privacy policies apply to their services. Barcode and recipe data may come from third-party databases and can be incomplete or wrong.

10. Disclaimer of warranties

LowKal is provided “as is.” We do not warrant that estimates are accurate, that the app will be uninterrupted, or that it will meet a health goal. To the fullest extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Some places do not allow these disclaimers. They apply to the maximum extent permitted.

11. Limitation of liability

To the fullest extent the law allows, Finnbrose Labs LLC and its people will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, lost profits, or health outcomes, arising from LowKal or the waitlist.

Our total liability for any claim relating to LowKal or the waitlist is limited to the greater of (a) the amounts you paid us for LowKal in the 12 months before the claim, or (b) $50 USD. If you have only joined the waitlist and have not paid, that means $50 USD.

Some places do not allow these limits. They apply to the maximum extent permitted. Nothing here limits liability that cannot be limited (including, where applicable, liability for death or personal injury caused by negligence, or for fraud).

12. Indemnity

If you misuse LowKal, violate these terms, or violate someone else’s rights, you will indemnify Finnbrose Labs LLC against the resulting claims and reasonable costs, to the extent the law allows.

13. Changes and shutdown

We may change these terms. We will post a new effective date. If a change is material and you have an account, we will give reasonable notice. Continued use after that is acceptance. If you do not agree, stop using LowKal and delete your account.

We may stop offering LowKal. If you have a paid period through Apple or Google, those stores’ rules govern any remaining time or refund.

14. Governing law

These terms are governed by the laws of the State of Pennsylvania, USA, excluding conflict-of-law rules, unless a mandatory consumer law in your place of residence says otherwise. Courts located in Pennsylvania will hear disputes that the law allows us to put there, except where you have a non-waivable right to sue where you live.

If you are a consumer in the EEA or UK, you keep any mandatory protections of your home country.

15. Other

These terms plus the Privacy Policy are the agreement for LowKal. If a section is unenforceable, the rest remains. We may assign these terms in a merger or sale of the business. You may not assign them. Failure to enforce a term is not a waiver.

Apple-specific: if you download LowKal from the App Store, you acknowledge the license is between you and Finnbrose, not Apple, and that Apple has no obligation to provide maintenance. Apple is a third-party beneficiary of this paragraph. You represent you are not in a US-embargoed country and not on a US government prohibited-party list.
